I make extensive use of Smart Albums. Smart Album settings seem to be sticky/persistent in Lightroom until Lightroom is restarted.
Backlight has the notion of importing/copying Smart Album and Album settings from an existing Smart Albums and Albums. However, it appears Smart Album matching rules are imported/copied. It's a real drag to have to recreate my rules every morning (I shut down Lightroom nightly).
My rules set is fairly limited at the moment, with only 5 rules, but I see this growing as I discover new "smarter" ways of leveraging my existing metadata tagging to automagically generate new and useful albums for my clients.
Even more potentially useful than importing previous Albums, would be the notion of saving Album and Smart Album templates, and applying templates to existing Albums and Smart Albums. I loath to think of having to update hundreds or thousands of Smart Albums with new rules.

Hi Mike,
Smart Albums, and in whatever way they apply to Publish Services, is all to do with Lightroom. If there are problems therein, those problems are on Adobe, and out of our hands.
